MindXP Terms of Use

Not legal advice, and not yet reviewed by a lawyer. This document describes how MindXP actually works and is written in good faith, but it has not been through legal review. It should be reviewed before MindXP is offered commercially at scale.
These terms govern your use of MindXP — the iOS and Android apps and the web app at getmindxp.com — provided by Matthew Watson. By using the app you agree to them. If you do not agree, please do not use the app.
Eligibility
You must be able to form a binding contract to use MindXP, and you must have an Apple Account capable of making purchases in order to subscribe. MindXP is not directed at children under 13.
What MindXP is
MindXP is a training app for mental skills: arithmetic and algebra, reading comprehension, vocabulary, memory, logic, science reasoning and language learning. It generates exercises, adapts their difficulty to your performance, and keeps a record of how you are doing.
What MindXP is not. It is not a medical device, a diagnostic tool, an IQ test, or a treatment for any condition. The ratings and the MindXP Profile summarise your performance inside this app and nothing more — they do not measure intelligence and they do not predict anything about you outside the app. MindXP makes no claim that training here improves cognitive ability in general, prevents cognitive decline, or affects any medical condition. Do not use it in place of professional medical advice.
Your account
You need an account to use MindXP and to sync your training across devices. You are responsible for keeping your sign-in credentials secure and for activity under your account. Provide accurate information when you register, and keep it current.
You may delete your account at any time from inside the app, which permanently deletes your data. We may suspend or terminate an account that is being used to attack, abuse or overload the service.
Subscriptions
MindXP is a paid product. Access requires an active subscription, purchased as an auto-renewing subscription through the App Store, through Google Play, or on the web at getmindxp.com. Two plans are offered — monthly and annual — and both include every feature, on every platform. Nothing is sold separately. The sections below describe a subscription bought through the App Store; one bought on the web is described under “Subscribing on the web”.
Free trial
New subscribers are normally offered a free introductory period. Its exact length is shown on the subscription screen in the app and confirmed on Apple’s purchase sheet before you buy; that sheet is the authority. Eligibility for an introductory offer is determined by Apple, once per subscription group per Apple Account, so it may not be available if you have subscribed to MindXP before. Where you are not eligible, the app says so and offers the ordinary price instead.
You are not charged during the free period. If you do not cancel before it ends, the subscription automatically converts to a paid subscription at the price shown at purchase. Any unused part of a free trial is forfeited if you purchase a subscription before it ends.
Billing and renewal
- Payment is charged to your Apple Account at confirmation of purchase, or at the end of the free trial.
- The subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the then-current price for your plan.
- Prices are set per App Store storefront and are shown in your local currency at the point of purchase. If a price changes, Apple will notify you and, where required, ask you to consent before the next renewal.
Cancelling
You can cancel at any time from Settings → your name → Subscriptions on your device, or from Profile → Manage Subscription inside MindXP, which opens the same screen. Cancelling stops the next renewal; it does not end the period you have already paid for, and you keep access until that period ends. Deleting the app does not cancel a subscription.
Refunds
Purchases are made through Apple, so refunds are handled by Apple under the Apple Media Services Terms and Conditions, not by us. Requests go to reportaproblem.apple.com. Statutory withdrawal and refund rights in your country are unaffected.
Subscribing on the web
A subscription bought at getmindxp.com is sold by Matthew Watson and paid through Stripe, our payment processor, in a secure payment form on getmindxp.com. The price, in US dollars, and any free trial are shown on the subscription screen and again in the payment form before you pay.
- A free trial is offered once per MindXP account, and only to an account that has never held a MindXP subscription on any platform. A card is taken at checkout; you are not charged during the trial, and if you do not cancel before it ends the subscription converts to the paid plan you chose.
- Your card is charged at purchase, or at the end of the free trial, and then at the start of each period. The subscription renews automatically for the same period until you cancel it.
- You can cancel at any time from Profile → Manage subscription at getmindxp.com. Cancelling stops the next renewal; you keep access until the end of the period already paid for, and you can resume before then. You can also switch between the monthly and annual plans — a switch takes effect straight away, and the new plan’s price is charged less credit for the unused part of the old one, with the exact amount shown before you confirm — and update your card, from the same place.
- If a renewal payment fails, we and Stripe will retry it for a short time and access may continue while we do; if it cannot be collected, the subscription ends.
- Deleting your MindXP account cancels a web subscription immediately, so you will not be charged again; any time left on it ends with the account.
- Refunds for a web subscription are handled by us: write to coincatcher14@gmail.com. Statutory withdrawal and refund rights in your country are unaffected.
A subscription unlocks MindXP on every platform you sign in to with the same account, wherever it was bought. Manage or cancel it where it was bought.
If a subscription ends
Your account and your entire training history are kept. Nothing is deleted because a subscription lapsed. Training features stop until there is an active subscription again, at which point your history, ratings and records are exactly as you left them.
Acceptable use
Please do not:
- attempt to access another person’s account or data;
- probe, scan, overload or otherwise interfere with the service or its infrastructure;
- use the pronunciation service, or any other server feature, as a general-purpose utility outside the app;
- reverse engineer, decompile or redistribute the app except where that restriction is prohibited by law;
- use the app in any way that breaks the law.
Content and ownership
The app, its exercises, its generated content and its design are owned by Matthew Watson and protected by copyright. You are granted a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, in accordance with the App Store Terms of Service. Your own training records remain yours.
Availability
MindXP works offline for training. Features that require the server — account sign-in, sync and on-demand pronunciation — depend on the service being available, and we do not guarantee uninterrupted availability. We may modify or discontinue features, and where a change is significant we will make it visible in the app.
Disclaimers and liability
The app is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. To the fullest extent permitted by law, Matthew Watson is not liable for indirect, incidental, special, consequential or exemplary damages, or for any loss of data or profits, arising from your use of the app. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
Apple
These terms are between you and Matthew Watson, not Apple. Apple has no obligation to provide maintenance or support for MindXP, and is not responsible for addressing any claim you may have relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app is also subject to the Apple standard End User Licence Agreement, which applies in addition to these terms.
Termination
You may stop using MindXP at any time and delete your account from inside the app. We may suspend or end access where these terms are breached. Ending access does not by itself cancel an App Store subscription — cancel that through Apple, as described above. A subscription bought on the web is cancelled when the account is deleted.
Changes and governing law
We may update these terms; the effective date above will change and the updated terms will be published here. Continuing to use the app after that constitutes acceptance.
A governing law and forum have not yet been selected, and one is deliberately not named here rather than asserted without basis. This is an outstanding item for legal review before commercial launch. Nothing in this section affects mandatory consumer-protection rights in your country of residence, which apply regardless.
